Gemäß § 24 Abs 2 NISG gelten Einrichtungen welche ein mittleres Unternehmen das in einem Sektor mit hoher Kritikalität gemäß den Anlagen 1 und 2 zum NISG tätig ist betriben als wichtige Einrichtungen. Eine Einrichtung gilt gemäß § 25 NISG unter anderem als „mittleres Unternehmen“, wenn sie zumindest 50 Mitarbeitende beschäftigt. Die NisExperts AG beschäftigt mehr als 50 Mitarbeitende und ist in einem Sektor mit hoher Kritikalität (Digitale Infrastruktur - Rechenzentrumsdienste) gemäß Z 8 Anlage 1 NISG tätig. Ob der Kund*innenstruktur könnte sich eine Störung des von der Einrichtung erbrachten Dienstes wesentlich auf die öffentliche Ordnung und die öffentliche Gesundheit auswirken, das bewirkt aber für sich keine Qualifizierung als "wesentliche Einrichtung". Die NisExperts AG ist sohin als wichtige Einrichtung iSd NISG zu qualifizieren.
