Although Austria’s National Council secured a simple majority in July 2024 for the implementation law (NISG-E), the law requires a two-thirds majority due to constitutional provisions, which was not reached. The main reason for opposition was the placement of the national cybersecurity authority within the Ministry of the Interior.[1] The authors do not expect significant changes to the uncontested provisions in future drafts, which is why the following sections are based on the current draft (NISG 2024; Telecommunications Act, eHealth Act, amendment (326/ME)[2] – referred to hereafter as NISG).
